Warranty terms and conditions 
The following terms apply to the warranty (the “Warranty”) provided by Klimabrands A/S (“KB”):
1. Definitions:
Unless otherwise stated in the text, the definitions set forth in KB’s Terms and Conditions shall apply to this Warranty.
2. Scope of application:
2.1 The warranty covers KB’s products purchased by KB’s direct resellers (“Reseller”) and which are or will be installed/used by private consumers. The warranty is provided solely for the benefit of the reseller (KB’s direct contracting party) and thus cannot be invoked by the reseller’s contracting party (including the End Customer) or any other third party – not even in the event of the Installer’s bankruptcy or if the reseller is subject to reconstruction proceedings.
Warranty is void for commercial use.
2.2 The warranty is valid for 2 years from the time the product is sold/installed to/at the End Customer, however, the product must be installed no later than 3 months after it has been sold to the reseller.
2.3 For heat pumps with extended warranty, the warranty is valid for 5 years from the time the heat pump is installed at the end customer, however, the heat pump must be installed no later than 3 months after it has been sold to the dealer.
2.4 The warranty only applies to air/water heat pumps that are registered on KB’s website no later than 2 weeks after installation at the End Customer or that are installed by KB’s service partners.
2.5 The warranty only covers products installed at an End Customer in the Nordic region (Denmark, Sweden, Norway & Finland) (only bridged islands).
2.6 KB may change the terms of the Warranty and revoke the Warranty at any time. Any amendment or revocation of the Warranty will be effective from the time of publication of the amendment or revocation on KB’s website (www.klimabrands.dk) and will apply to products ordered after that time.
3. Warranty:
3.1 The warranty covers (provided that the conditions for the warranty as described in section 4 are met) manufacturing defects and material defects on products that appear during the warranty period and that have occurred during normal operation.
3.2 In case of manufacturing and material defects covered by the warranty, KB will – at KB’s sole discretion – either repair and/or replace spare parts or replace the product. The warranty does not cover costs due to space conditions making the work particularly difficult or costs for equipment such as crane, lift, scaffolding, etc. Warranty work must be carried out by an installer selected by KB. Repair work carried out without prior agreement with KB is not covered by the warranty and will not be replaced by KB. Plug&Play products are never repaired at the end customer but are returned to KB’s workshop in DK-9900 Frederikshavn after approval from KB.
Repair, replacement of parts or exchange does not automatically trigger a new warranty period.
3.3 The Warranty does not give Reseller any rights other than those set out in this Warranty, and Reseller may not make any claims against KB of any kind, including claims for proportionate reduction, compensation, including compensation for electricity costs, troubleshooting, liquidated damages or similar. It is clarified that the Warranty is provided solely for the benefit of the reseller (KB’s direct contractual party), as further described in section 2.2, according to which the End Customer or any other third party may not make any claims against KB of any kind.
3.4 If, during the warranty work, it turns out that the fault on the product is not covered by the Warranty, but is due to incorrect assembly, handling, use, lack of cleaning, lack of maintenance or similar, and in the event of a call-out due to the retailer’s unwillingness to attempt to restart the product after instructions from technical support, the person/company that has created the case with KB will be invoiced for the time spent in connection with the call-out, troubleshooting, repair and/or replacement, at KB’s current hourly rate of 950 DKK ex VAT plus travel and material consumption.
3.5 The warranty does not apply if defects in the product are due to
- External conditions, foreign elements;
- Changes or additions to the product;
- Incorrect use, incorrect installation, incorrect setup in product management;
- Vandalism, neglect;
- We do not provide a surface warranty on our products if they have been used in coastal areas.
Coastal areas are defined as typically 10 km from the coast – in special cases it can be up to 25 km from the coast due to wind conditions. - Insufficient network, router failure or app challenges;
- Faults caused by conditions or faults in the building’s electrical installation, pipe installation, water pipe size, floor heating, radiator size, etc;
- Interconnection or installation of products with other heat generators such as solar heating, external controls, pumps and similar that are not intended for the purpose;
- Storm, frost, corrosion, lightning, surge, earthquake, flood, hail, landslide, flood, explosion, fire and force majeure in general.
- Specifically robotic vacuum cleaners that are not regularly cleaned of hair and particles that restrict the movement of wheels and the motor.
3.6 The following conditions are not considered manufacturing or material defects and are therefore not covered by the warranty:
- Lack of refrigerant on products with refrigerant.
- Visual deterioration that has occurred after delivery.
- Parts that can be considered as normal wear parts, including filters, valves, sensors including mechanical sensors, heat exchangers, circulation pumps, controls including mechanical relays, motors including fan motors and similar parts.
4. Conditions for warranty:
4.1 KB has prepared a handover report form for the delivery of air to water heat pumps. This handover report must be completed when the installation is handed over to the End Customer. The handover report must be retained by the End Customer, possibly with a copy at the Installer.
4.2 Products must be installed by an authorized and certified refrigeration installer and the applicable legislation must be followed. The relevant principle diagram must be followed, see point 3.4. All electrical work in connection with the installation must be carried out by an authorized electrical installer and all plumbing work must be carried out by an authorized plumber.
As documentation, installation invoices for the installation of both air/air and air/water heat pumps and other installation products are required.
4.3 Products must be serviced by an authorized and certified refrigeration installer approved by KB and comply with applicable legislation. KB has prepared a service report form, which can be obtained by contacting KB, which must be completed in connection with the servicing of air/water heat pumps. In relation to this guarantee, KB requires that all air/water heat pumps, regardless of filling volume, are serviced at least once a year.
4.4 If the above conditions in sections 4.1 to 4.3 for the Warranty are not met, the Warranty will be void and no claims of any kind can be made against KB in this connection.
5. Invoking the warranty:
5.1 Warranty claims must be submitted via https://klimabrands.dk/rma/, during the warranty period and immediately after the defect is discovered. Other inquiries will not be handled.
5.2 The notification in accordance with clause 5.1 must be accompanied by the original sales invoice, for air-to-water heat pumps proof of a completed Handover Report in accordance with clause 4.1. Likewise, the notification in accordance with clause 5.1 must also be accompanied by copy(ies) of the service report if the air/water heat pump is older than 1 year, see clause 4.3.
5.3 KB may reject a claim if the defect is insufficiently described or no relevant documentation is provided.
6. Choice of law and jurisdiction:
6.1 The warranty is subject to the same provisions regarding choice of law and jurisdiction as apply to the Terms of Sale and Delivery, cf. clause 16 of the Terms of Sale and Delivery.
